Court-Certified Mediation
Mediation provides an alternative to divorce litigation. Mediation is a process designed to facilitate open communication and cooperation amongst the divorcing parties to reach a mutually-agreeable settlement. Mediation allows parties to freely negotiate and tailor the terms of their divorce settlement in an open, confidential environment. The mediator is a neutral facilitator who oversees the mediation process, helps the parties resolve any issues in a non-adversarial manner, and ultimately aids the parties in arriving at a settlement. Unlike attorneys representing divorcing clients in litigation proceedings, court-certified mediators, although licensed attorneys, are not acting on behalf of the parties in a representative capacity, thus they are able to help the parties make progress toward settlement in an unbiased fashion. In effect, mediation moves away from adversarially litigated divorce decrees in favor of mutually-negotiated agreements that are tailored to the parties’ particular circumstances and that take into account each party’s individual values.
